One honest caveat. Even though the apostille is legally valid, a few Indian receiving parties, certain attorneys or local offices, still ask out of habit for consular attestation. Which US authority apostilles your document

The office that issues your apostille depends on who issued the document, not on India. Get this right and the rest is straightforward.

  • State documents are apostilled by the Secretary of State in the issuing state. A California birth certificate, a Texas degree notarization, a New York certificate of good standing, each goes to that state.
  • Federal documents are apostilled by the US Department of State. An FBI background check or a Consular Report of Birth Abroad is federal, so it goes to the federal level, not a state.

People preparing an Indian work visa or an OCI file often need documents from both levels at once, a state birth certificate and a federal FBI check, for example. Sending either to the wrong office means it returns unprocessed. Translation needs for India

Here is a real advantage with India. English is an official language used across government, courts and universities, so a US document already in English usually needs no translation at all.

That is a meaningful difference from a country like China or Italy, where a certified translation rides alongside almost every document. For India, your English birth certificate, degree or background check is generally accepted as is, once apostilled. The apostille certificate itself is bilingual by design, so it never needs translating.

There are a couple of exceptions. If your document is in a language other than English, you will need a certified English translation. The OCI card, done right
